Of course, you are in love and planning your future together, and the thought of separating seems impossible. So, when someone suggests a prenuptial agreement (or “prenup”), it might feel unnecessary or even unromantic. But the truth is, life changes. People grow, circumstances shift, and not all marriages last forever.

Think of a prenuptial agreement like insurance: you hope never to use it, but you’ll be thankful it’s there if the unexpected happens.

A prenuptial agreement is a legal contract signed before marriage. It outlines how property, debt, and support will be handled in the event of a separation or divorce.

Essentially, it covers any issues that will arise if the marriage does not work out.

The following are elements that a prenup agreement in BC must have to be considered valid and enforceable:

  • Full financial disclosure
  • Absence of distress
  • Independent legal advice
  • Sufficient time for negotiations
  • Compliance with the BC Family Law Act and Divorce Act

It is recommended that you do not draft your own prenup. It is unlikely that you will have all the knowledge to draft one and retaining a lawyer that is able to draft it and review it will be beneficial to ensure that your respective rights are being protected.
